CBD regulation across Europe: why one rule does not fit every country

The shared EU layer
The European Commission treats foods without significant EU consumption before 15 May 1997 as novel foods requiring pre-market authorisation. Its catalogue is an orientation tool rather than a complete permission list, and member states can apply specific restrictions.
A 2023 Commission committee statement said a significant pre-1997 food history had not been demonstrated for CBD and other cannabinoids. THC also remains subject to controlled-drug and contaminant rules depending on context.
Why country outcomes differ
A bottle can fall into different regimes depending on whether it is sold as food, cosmetic, medicine, vape liquid or another chemical mixture. National authorities may also take different views on flowers, extracts, trace THC, marketing language and enforcement.
